Form I-821 - Application for Temporary Protected Status (TPS)

What is Form I-821, Application for Temporary Protected Status?

Temporary Protected Status (TPS) is a designation for nonimmigrants used by the Department of Homeland Security for the residents of countries experiencing instability.

In other words, people from countries in the middle of civil war, epidemic disease, natural disaster or other problems are allowed to extend their stay in the U.S. with TPS.

Form I-821, Application for Temporary Protected Status, grants the people from these affected countries extended status in the U.S. as well as a right to work. It's important to note that TPS cannot be extended indefinitely.


Who is eligible for TPS?

The USCIS publishes a list of countries whose residents are eligible for Temporary Protected status. Below is the list of countries whose residents are eligible for TPS as of today and the date at which TPS expires for them:

  • El Salvador - March 9, 2018
  • Guinea - May 21, 2017
  • Haiti - July 22, 2017
  • Honduras - January 5, 2018
  • Liberia - May 21, 2017
  • Nepal - June 24, 2018
  • Nicaragua - January 5, 2018
  • Sierra Leone - November 21, 2016
  • Somalia - March 17, 2017
  • Sudan - November 2, 2017
  • South Sudan - November 2, 2017
  • Syria - March 31, 2018
  • Yemen - March 3, 2017

How do I apply for TPS?

The process for applying for TPS involves the following steps:

  • Fill out form
  • Attach supporting documentation as per the instructions
  • Send form in to appropriate USCIS office
  • Attend biometrics appointment at USCIS office
  • Wait for USCIS to make a decision

How long does it take to get Temporary Protected Status?

The USCIS California Service Center estimates the wait time for Form I-821 to be at least three months. Filing your TPS application must occur in one of the USCIS' enrollment periods.


How much does it cost to get Temporary Protected Status

The following is a breakdown of the different fees associated with Form I-821 with application assistance:

Initial Temporary Protected Status:
